Overview: Section 11.6 of S.L. 2026-41 (Senate Bill 257) extends the expiration of the provisions authorizing natural gas local distribution companies to recover certain costs for natural gas economic development infrastructure created by S.L. 2016-118. As established by S.L. 2016-118, if a business undertaking a project requiring natural gas complied with certain criteria, the natural gas distribution company providing that natural gas service was eligible to recover reasonable and prudent costs, including planning and development costs, construction costs, a revenue retention factor, depreciation, and property taxes, as determined by the Utilities Commission.

These cost-recovery provisions were set to expire on July 1, 2021. This expiration was extended by S.L. 2020-58 to July 1, 2026. This section extends the expiration to July 1, 2036.

This section became effective July 1, 2026.
